Two narrations of Umar bin al Khattab where he praised the women who killed their rapist.

1. Ibn al Qayyim said:

قال الليث بن سعد : أتي عمر بن الخطاب يوما بفتى أمرد ، وقد وجد قتيلا ملقى على وجه الطريق ، فسأل عمر عن أمره واجتهد فلم يقف له على خبر ، فشق ذلك عليه ; فقال : اللهم أظفرني بقاتله ، حتى إذا كان على رأس الحول وجد صبي مولود ملقى بموضع القتيل ، فأتي به عمر ; فقال : ظفرت بدم القتيل إن شاء الله تعالى ; فدفع الصبي إلى امرأة ، وقال لها : قومي بشأنه ، وخذي منا نفقته ، وانظري من يأخذه منك ; فإذا وجدت امرأة تقبله وتضمه إلى صدرها فأعلميني بمكانها . فلما شب الصبي جاءت جارية ، فقالت للمرأة : إن سيدتي بعثتني إليك لتبعثي بالصبي لتراه وترده إليك ، قالت : نعم ، اذهبي به إليها ، وأنا معك . فذهبت بالصبي والمرأة معها ، حتى دخلت على سيدتها ، فلما رأته أخذته فقبلته وضمته إليها ; فإذا هي ابنة شيخ من الأنصار من أصحاب رسول الله صلى الله عليه وسلم فأتت عمر فأخبرته ، فاشتمل على سيفه ، ثم أقبل إلى منزل المرأة . فوجد أباها متكئا على باب داره ، فقال له : يا فلان ، ما فعلت ابنتك فلانة ؟ . قال : جزاها الله خيرا يا أمير المؤمنين ، هي من أعرف الناس بحق الله وحق أبيها ، مع حسن صلاتها وصيامها ، والقيام بدينها . فقال عمر : قد أحببت أن أدخل إليها ، فأزيدها رغبة في الخير ، وأحثها عليه ; فدخل أبوها ، ودخل عمر معه . فأمر عمر من عندها فخرج ، وبقي هو والمرأة في البيت ، فكشف عمر عن السيف ، وقال : أصدقيني ، وإلا ضربت عنقك ، وكان لا يكذب . فقالت : على رسلك ، فوالله لأصدقن : إن عجوزا كانت تدخل علي فأتخذها أما ، وكانت تقوم من أمري بما تقوم به الوالدة . وكنت لها بمنزلة البنت ، حتى مضى لذلك حين ، ثم إنها قالت : يا بنية ، إنه قد عرض لي سفر ، ولي ابنة في موضع أتخوف عليها فيه أن تضيع ، وقد أحببت أن أضمها إليك حتى أرجع من سفري ، فعمدت إلى ابن لها شاب أمرد ، فهيأته كهيئة الجارية ، وأتتني به ، لا أشك أنه جارية ; فكان يرى مني ما ترى الجارية من الجارية ، حتى اغتفلني يوما وأنا نائمة ، فما شعرت حتى علاني وخالطني ، فمددت يدي إلى شفرة كانت إلى جانبي فقتلته . ثم أمرت به فألقي حيث رأيت ، فاشتملت منه على هذا الصبي ، فلما وضعته ألقيته في موضع أبيه . فهذا والله خبرهما على ما أعلمتك . فقال : صدقت ، ثم أوصاها ، ودعا لها وخرج . وقال لأبيها : نعمت الابنة ابنتك ; ثم انصرف

Al-Layth ibn Sa’d (the trustworthy, renowned scholar, died 175 AH) reported:

“A beardless youth was brought to Umar ibn al-Khattab (may Allah be pleased with him) after being found murdered, facedown on a road. Umar investigated thoroughly but could uncover no information about the killer. This troubled him deeply, and he prayed: ‘O Allah, help me find his murderer!’

Near the year’s end, an abandoned newborn was discovered at the same location. When brought to Umar, he declared: ‘By Allah’s will, I have found the key to this bloodshed!’ He entrusted the infant to a woman, instructing: ‘Care for him at our expense. Observe who takes him—if any woman embraces him affectionately, inform me immediately.’

When the child grew, a maidservant came saying: ‘My mistress sent me to see the boy.’ The caretaker accompanied them. Upon seeing him, the mistress (daughter of an Ansari companion of the Prophet ﷺ) kissed and clung to him.

Umar, upon hearing this, concealed his sword and went to her home. Finding her father at the door, he asked about her. The father praised her piety. Umar said: ‘I wish to encourage her further in good deeds.’ The father replied: ‘Wait here while I Return to your place.

Permission was sought for Umar to enter. When he came in, Umar ordered everyone present with her to leave, and they departed until only she and Umar remained in the house with no one else present. Umar then uncovered his sword and said: “You shall tell me the truth,” for Umar never lied.

She replied: “Hold on, O Commander of the Faithful, for by Allah I shall indeed speak the truth. There was an old woman who used to visit me, and I took her as a mother. She cared for my affairs as a mother would, and I was to her like a daughter. This continued for some time, until one day she said: ‘My daughter, I must travel and I have a daughter in another place whom I fear may be lost. I wish to bring her to stay with you until I return from my journey.’

So she took her beardless young son and dressed him in girls’ clothing, then brought him to me. I had no doubt he was a girl. He saw from me what a girl would see from another girl, until one day when I was asleep, he overpowered me. Before I knew it, he was upon me and had intercourse with me. I reached for a blade that was beside me and killed him. Then I ordered him to be disposed of where you saw. From him I became pregnant with this boy by him, and when I gave birth, I placed them where their father had been. This, by Allah, is their story exactly as I have informed you.”

Umar said: “You have spoken the truth. May Allah bless you.” Then he advised her, admonished her, and prayed for her before departing.

He said to her father: “May Allah bless your daughter. What an excellent daughter she is! I have advised and instructed her.”

Her father replied: “May Allah keep you steadfast, O Commander of the Faithful, and reward you with good for your care of your subjects.”

Ibn kathir said the chain is broken but accepted the text saying:

وفيه فوائد كثيرة منها حزق عمر رضى الله عنه وحسن تأنيه وجوده فراسته وفيه انه يجوز دفع الصائل زانه لا ضمان عليه فى قتله حيث لم يؤمر فيه بالدية والله اعلم

This narration contains many important benefits:

1. It demonstrates Umar’s (may Allah be pleased with him) sharp intellect, his excellent patience, and his outstanding discernment.

2. It proves that repelling an aggressor is permissible, and there is no financial liability for killing them, since no blood money (diyah) was mandated in this case.

Same way Ibn al Qayyim accepted the text, he said before quoting this narration:

ولله فراسة من هو إمام المتفرسين ، وشيخ المتوسمين : عمر بن الخطاب رضي الله عنه الذي لم تكن تخطئ له فراسة ، وكان يحكم بين الأمة بالفراسة المؤيدة بالوحي .

To Allah belongs the divine insight of him who was the Imam of the discerning and master of the perceptive: Umar ibn al-Khattab (may Allah be pleased with him), whose judgment by insight never erred. He governed the Ummah with a discernment supported by divine inspiration.

2. Abdur Razzaq narrated:

17919 – عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ قَالَ: أَحْسِبُهُ عَنْ عُبَيْدِ بْنِ عُمَيْرٍ قَالَ: اسْتَضَافَ رَجُلٌ نَاسًا مِنْ هُذَيْلٍ، فَأَرْسَلُوا جَارِيَةً لَهُمْ تَحْتَطِبُ، فَأَعْجَبَتِ الضَّيْفَ فَتَبِعَهَا، فَأَرَادَهَا عَلَى نَفْسِهَا، فَامْتَنَعَتْ فَعَارَكَهَا سَاعَةً فَانْفَلَتَتْ مِنْهُ انْفِلَاتَةً، فَرَمَتْهُ بِحَجَرٍ، فَفَضَّتْ كَبِدَهُ فَمَاتَ، ثُمَّ جَاءَتْ إِلَى أَهْلِهَا، فَأَخْبَرَتْهُمْ فَذَهَبَ أَهْلُهَا إِلَى عُمَرَ، فَأَخْبَرُوهُ، فَأَرْسَلَ عُمَرُ، فَوَجَدَ آثَارَهُمَا، فَقَالَ عُمَرُ: «قَتِيلُ اللَّه لَا يُودَى أَبَدًا»،

Ubayd ibn `Umayr narrated that a man hosted some people from (the tribe of) Hudayl. They sent a slave woman to fetch some firewood and the host was attracted to her, so he followed her (into the woods) and wanted to have his way with her but she refused. He wrestled with her for a while, until she escaped from him and threw a rock at him and killed him. Her masters went to `Umar and informed him of the situation. `Umar sent investigators who found their tracks and thereafter `Umar said “ No diyah (or qisas – expiation in terms of blood money or etc) is to be paid for the one who was Killed by Allah”

Scholars based their fatwa on above.

1. al Baghwi (433 to 516 AH) said:

وَكَذَلِكَ لَوْ قَصَدَ رَجُلٌ الْفُجُورَ بِامْرَأَةٍ، فَدَفَعَتْهُ عَنْ نَفْسِهَا، فَقَتَلَتْهُ لَا شَيْءَ عَلَيْهَا، رُفِعَ إِلَى عُمَرَ رَضِيَ اللَّهُ عَنْهُ جَارِيَةً كَانَتْ تَحْتَطِبُ، فَاتَّبَعَهَا رَجُلٌ، فَرَاوَدَهَا عَنْ نَفْسِهَا، فَرَمَتْهُ بِفِهْرٍ، أَوْ حَجَرٍ فَقَتَلَتْهُ، فَقَالَ عُمَرُ: «هَذَا قَتِيلُ اللَّهِ، وَاللَّهِ لَا يُودَى أَبَدًا».

وَعَلَى هَذَا الْقِيَاسِ لَوْ قَصَدَتْ بَهِيمَةٌ رَجُلا، فَقَتَلَهَا فِي الدَّفْعِ، لَا ضَمَانَ عَلَى الدَّافِعِ عِنْدَ الأَكْثَرِينَ، وَهُوَ قَوْلُ الشَّافِعِيِّ،

If a man forcefully tries to have illegal sex with a woman and she prevents him from her and kills him then there is nothing (i.e. no sin or qisaas) on her. It is related from Umar a man wanted [to rape] a woman, so she threw a rock at him and killed him. ‘Umar said, ‘ Allah killed him, By Allaah, there is no diyah for him ever’ i.e., she did not have to pay the ‘blood money’ for him… This is also the saying of al Shafiee.[Sharah al Sunnah 10/252]
